FULL MOON Trail 2024 Rules

The event regulations, together with the entry form, constitute the contract between the organiser and the participants. They must be brought to the attention of the participants by any possible means, without it being necessary to initiate the entry procedure.

Entry implies formal acceptance of the rules by the participant, either by signing the entry form or by accepting these rules by ticking the corresponding box in the case of an electronic entry procedure.

ARTICLE 1 - ORGANIZATION

The FMT Association (hereinafter the "Organization" or the "Organizer"), in collaboration with the towns of Aix-en-Provence, Gardanne, Mimet, Simiane-Collongue, Bouc-Bel-Air, Septèmes-les-Vallons and Marseille, is organizing the 3rd edition of the FULL MOON trail from Aix-en-Provence to Marseille on Sunday April 21, 2024, including the following events:

These events are open to all, women or men, licensed or not, with the following minimum ages on the day of the race:

  • Estello course ≥ 18 years
  • Phocea course ≥ 18 years
  • Pitchoune ≥ 18 years old

The routes are presented HERE and are authentic.

ARTICLE 2 - ADMISSION REQUIREMENTS - ENROLMENT

The registration implies knowledge and acceptance of the present rules and of the ethics of the race, in particular the eco-responsible charter, and of any instructions sent by the Organization to the participants. They are open on the LIVE TRAIL site, accessible via the site www.fullmoontrail.fr

Registration is effective when the competitor has :

  • completed the online registration form
  • paid the registration fee, as well as the processing fee for the registration platform
  • electronically signed the eco-responsible charter proposed by the organizer
  • issued a medical certificate of no contraindication:
    • to the practice of competitive sport
    • or competitive athletics
    • or competitive mountain running
    • less than one year old at the time of the competition. 

No other document can be accepted as proof of possession of the medical certificate.

Concerning licences :

  • If you are an FFA licence holder: you must present your licence at the time of registration: Please note: Health, Management and Discovery licences issued by the FFA are not accepted.
  • If you are a UFOLEP licence holder: your licence will only be accepted if it says "athletics in competition" or "running in competition" on the back.
  • If you are an FFCO licence holder: you must present a medical certificate stating that you are not contraindicated to practice sport in competition or athletics in competition or running.
  • If you have a sports licence issued by another approved federation (e.g. FFTri, FFCAM, etc.), the fact that you are not contraindicated in practising sport in competition, athletics in competition or running in competition must appear on the licence (on the front or back).

The price includes registration for the race (race number), access to refreshment points (course refreshment points and finish area), post-race snack, prizes offered by the event's partners.

Registrations and, more generally, all relations with runners are managed by ERIC AU CARRE, a specialised service provider appointed by the Organiser and acting in its name and on its behalf in all circumstances.

No on-site registration.

The organizer reserves the right to close registrations at any time, depending on administrative or regulatory constraints imposed by the various authorities.

Commitment

All registrations are personal, firm and final, and cannot be reimbursed for any reason whatsoever, except under the conditions set out in Article 14.

Transfer of number 

The organizer accepts changes of runners. Any registered runner may therefore transfer his or her race number to a replacement runner, provided that he or she has contacted the organizer beforehand to provide the surname, first name, date of birth and medical certificate of the replacement runner for validation. This transfer must be made no later than 23:59 on 16/04/2024.

ARTICLE 3 - DELIVERY OF RACE NUMBERS

Bibs will be handed out at the Décathlon village in Bouc-Bel-Air, on Friday April 19, 2024 from 4pm to 8pm; and at the Terrasses du Port shopping center on Saturday April 20, 2024 from 10am to 6pm.

The collection of the number by a third party is possible provided that the participant's identity document and medical certificate are presented.

The race number must be attached at the front and visible throughout the race. The logos and names of the event's partners must not be obscured or modified by the bib number.

Please note: the organizer does not provide pins for race numbers.

Participants will comply with all health measures in force on the day of the race.

ARTICLE 5 - COURSE & RACE INSTRUCTIONS

This event is organised in the pure sportsmanship of trails, the routes are traced in a fragile natural space classified NATURA 2000, in majority on path.

The routes are not looped and therefore require you to plan your journey to the starting point or back.

The Estello and Phocea routes are fully marked with tape and arrows.

Official checkpoints and feed stations are located on the circuits. Riders are informed during the pre-race briefing and the checkpoints and feed points are mentioned on the official routes posted on www.tracedetrail.fr and www.fullmoontrail.fr

Random checkpoints will be organised to ensure that participants follow the entire course.

 

Refreshments:

  • In order to respect the principle of semi-autonomy and fairness between runners, "off" refreshments ( i.e. outside the zones) offered by helpers and assistants are forbidden. Assistance in the feed zones is tolerated, subject to the authorization of the person in charge of the feed point (identifiable vest).
  • Refreshment points in Gardanne, Mimet, Septèmes les Vallons and Parc Foresta will offer both solid and liquid food.

The persons authorised to hand out the supplies must remain within the defined zone, they must not enter the course or hinder a rider. They may place the supplies in the rider's hand.

The riders are semi-sufficient. This requires a certain amount of autonomy. Runners must not rely solely on the feed stations. It is therefore compulsory to carry a sufficient supply of food and drink throughout the race to reach 2 feed points, provided that this is done from the start or after recovery at an official station. The refreshment points are indicated on the roadbook which can be consulted or downloaded from the race website.

Personal assistance may be provided at the refreshment posts, within a perimeter close to the refreshment post (about 50m).

    Rider entries :

    The runners agree to :

    • Respect the fauna and flora, stay on the marked routes and to not leave anything behind;
    • Pass the checkpoints with their bib on their chest or belly, so that they can be identified;
    • Provide the mandatory equipment: see summary table article 4.
    • Keep their headlamps on until the finish, and in any case until at least 8am, especially on the urban sections at the end of the course.

    Failure to comply with these instructions shall result in the disqualification of the runner.

    Race marshals at refreshment and control points, members of first-aid organizations and runners who are members of the organization have full authority to stop a runner who is showing excessive signs of fatigue or is running late.

    In case of withdrawal: report to a checkpoint or by telephone to the number written on your bib.

    Support for runners :

    Assistance to riders, whether by the use of certain equipment or by the use of one or more attendants, is prohibited.

    The use of devices for listening to music during the competition is tolerated under the exclusive responsibility of the user (the isolation from the environment provided by these devices does not allow for the identification of certain dangers and is a risk factor for the wearer and for third parties). GPS pedometers and heart rate monitors are not considered as an aid.

    A medical examination carried out during the event by a person from the medical service designated by the organiser and clearly identified by armbands, vests or similar distinctive means, shall not be considered as assistance.

    ARTICLE 6 - AWARDS - RANKING

    The ranking established by the LiveTrail company is authoritative.

    Estello, Phocea & Pitchoune podiums: first 3 Scratch times (M/F) and first in each category, without accumulation.

    • Complaints: All complaints must be made in writing and submitted to the Race HQ within a maximum of 2 hours after the arrival of the rider concerned.
    • The Jury of the event is composed of :
      • the President of the organizing company
      • the Race Director
      • the person in charge of the signallers-markers-rows
      • a runner representative

    The Jury is empowered to rule within a time limit compatible with the requirements of the race on all complaints made during the event. Decisions are final.

    ARTICLE 7 - TIME BARRIERS AND DISQUALIFICATIONS

    Exceeding the time limits will result in the runner being disqualified from the race: see details in article 1.

    The time barriers are integrated in the passage tables on the official tracks (tracedetrail.fr).

    Runners who are declared out of the race at the time barrier and who wish to finish their course will do so under their own responsibility. Any rider wishing to lodge a complaint must do so in writing to the race director at the finish.

    ARTICLE 8 - SAFETY AND RESCUE

    A safety and rescue center is set up in the arrival village. Its management is entrusted to an association recognized and authorised by the public authorities or to a professional rescue organization. Emergency services can be mobilized on the course if necessary.

    Doping controls may be carried out by the competent administrative and health authorities.

    The organizer will comply with the directives of the various authorities.

    It is forbidden to follow the riders with a motorised vehicle or electric bicycle.

    Access to certain car parks around the two start sites and assistance with parking are provided by volunteer members recognised by the organiser: following their instructions is compulsory.

    In order to gain access to the site and to be able to participate, the participant acknowledges and expressly accepts that the organiser may call upon security personnel who will be authorised to check both persons and personal effects. Any person wishing to access the site agrees to submit to this control. In case of refusal, the person will not be allowed to access the site.

    First aid posts are located along the course. The medical service and the first aiders are authorised to disqualify any runner who appears unfit to continue the race. Their number will be withdrawn, indicating that they will be disqualified from the race.

    1/ The GSM network may not work everywhere. Nevertheless, you must bring a mobile phone that is charged and switched on during the race and register the number of the race headquarters (it will be given to you on race day and will be written on your number).

    These aid stations are intended to provide assistance to any person in danger using the organisation's own resources. It is the responsibility of a rider in difficulty or seriously injured or who witnesses an accident to call for help either : - by going to an aid station; - by calling race headquarters (number provided at the briefing); - by asking a volunteer or another rider to call for help.

    It is the responsibility of each rider to assist any person in danger and to notify the emergency services.

    3/ A rider who calls on the services of a doctor or first-aid attendant submits to his authority and agrees to accept his decisions. First aiders and doctors are authorised to:

    • to disqualify any competitor unfit to continue the event
    • to evacuate, by any means at their disposal, any riders they consider to be in danger

    4/ If a runner decides to abandon, he/she must go to the next feed station to report his/her abandonment and hand in his/her number to the organisation. A runner must not leave the race route without notifying the race headquarters, in order to avoid any unnecessary search.

    Any person who is no longer on the official race route is no longer under the responsibility of the organiser (e.g. a rider who decides of his own accord to stop the race and return by his own means without notifying race headquarters).

    ARTICLE 9 - INSURANCE

    Article 9-1 - Civil Liability

    In accordance with the legislation in force, the Organiser has taken out insurance covering the financial consequences of its civil liability and that of its employees participating in the event. The Organiser is solely responsible to the participants for any damage resulting from the organisation of the FULL MOON TRAIL and is solely entitled to take action against its service providers or partners acting in its name and on its behalf.

    With regard to the civil liability of participants, the intervention of this insurance for the latter is limited to accidents that they may cause during the course of the event.

    This guarantee will be provided in addition to, or as a substitute for, other insurance policies that participants may have elsewhere.

    It only takes effect on the official route, for the duration of the event, for participants who are regularly registered and racing.

    Article 9-2 - Individual Insurance

    Licensees benefit from the guarantees granted by the insurance linked to their license.

    It is the responsibility of the other participants to insure themselves personally for civil liability and to cover, in particular, the costs of rescue, search and evacuation in France.

    Article 9-3 - Material damage

    The Organiser declines all responsibility for damage (theft, breakage, loss, etc.) to participants' personal property.

    It is the responsibility of each participant to insure themselves against this type of risk with their insurer. Participants acknowledge that the organiser cannot be held responsible for the surveillance of personal belongings in the event of theft or loss. In this case, participants will not be able to claim against the organiser for any damage caused to their equipment.

    ARTICLE 10 - SAFETY AND WEATHER

    For safety reasons, in particular in the event of unfavourable weather conditions endangering the safety of the runners, the Organiser reserves the right to stop the event (even in progress), to modify the course and the time limits after validation by the administrative authorities, or even to cancel the race without prior notice, without the runners being able to claim any compensation or any reimbursement of the registration fee.

    Riders are informed at registration that there is no alternative route.

    ARTICLE 11- PRIVACY - IMAGE RIGHTS - PERSONAL DATA

    Article 11-1 - Privacy

    By registering, each participant expressly authorises the organisers to publish his or her first name, surname and date of birth in the results and rankings of the competition and on the FFA website.

    Each participant also authorises the communication of his or her details to the event's partners.

    If participants wish to object to the publication of their results or the dissemination of their details, they must expressly inform the organiser.

    Article 11-2 - Image rights

    Image of the rider

    The FULL MOON trail may be captured for the purpose of communication to the public, in any form (notably photo, video...), on any existing or future support, in any format, for any communication to the public worldwide, for any use including advertising and/or commercial purposes.), on any existing or future medium, in any format, for any communication to the public in the whole world, for any use including advertising and/or commercial purposes, each participant expressly authorizes the Organizer, its beneficiaries or assigns (including its partners) to fix and reproduce, on any medium and by any means, and consequently, to reproduce and represent, without remuneration of any kind, his name, voice, image, and more generally his sports performance within the framework of the event, for a period not exceeding 5 years following the date of the Event. The participant expressly authorizes the Organizer to grant sub-licenses to the partners of the Event for the commercial and advertising use of the Image.

    To this end, each participant expressly and irrevocably authorises the Organiser, its beneficiaries, its successors (in particular its partners), in order to meet the requirements of advertising, promotional and/or commercial campaigns, to :

    • Make any modification, addition or deletion that it deems useful for the exploitation of its Image under the conditions defined above,
    • Associate and/or combine with its Image, all signatures, catchphrases, slogans, captions, trademarks, distinctive signs, legal notices, visuals and, in general, any element of any kind chosen by the Organiser, intended in particular to illustrate the communication media in which they are integrated.

    The Rider guarantees that he/she is not bound by any exclusive contract relating to the use of his/her Image.

    The runner is informed and accepts without reservation that his participation in the Event implies the capture of his image by the Organiser's partners. With regard to the Event website, the participant accepts that he/she may be identified by any internet user by his/her name, first name or race number;

    All riders expressly waive their right to use their image during the event, as well as any recourse against the Organiser and its approved partners for the use made of their image.

    Image of the event

    Any communication of still images and/or animated sequences of the event captured by the participant during his/her participation in the event must be limited to personal use and may not under any circumstances be used for promotional and/or commercial purposes outside the event.

    Article 11-3 - Personal Data

    By choosing to take part in the event, runners acknowledge that their progress on the course will be accessible to all users via the LiveTrail / Sportimers timekeeper's website.

    Runners acknowledge that any user of the application or the internet is likely to be able to follow the participants in the event by entering their name and/or first name and/or race number.

    At the end of the event, information relating to the sporting performance of each rider (in particular the results, photos and videos) are published on the event website. The results, images, photographs and videos may be used by any media or partner of the event.

    The ORGANIZER implements the processing of personal data, in co-processing with its service provider ERIC AU CARRE (hereinafter the "Data Processors").

    The legal basis for the processing of personal data is :

    • the legitimate interest pursued by the Data Controllers when they pursue the following purposes
      • prospecting and animation ;
      • rider registration, rider relationship management:
      • management of the relationship with its partners, prospects ;
      • organisation, registration and invitation to Data Controller events.
    • the performance of pre-contractual measures or of the contract when implementing a processing operation whose purpose is :
      • production, management, follow-up of contracts with riders;
      • recovery.
    • compliance with legal and regulatory obligations when implementing processing for the purpose of :
      • billing ;
      • accounting.

    The Data Processors only keep the data for the time necessary for the operations for which they were collected and in compliance with the regulations in force.

    In this respect, riders' data is kept for the duration of the contractual relationship plus 3 years for the purposes of promotion and canvassing, without prejudice to the retention obligations or limitation periods. As regards accounting, they shall be kept for 10 years from the end of the accounting period.

    Prospective customers' data is kept for a period of 3 years if no participation or registration to the Organiser's events has taken place.

    The data processed is intended for the authorised persons of the Organiser, as well as for its service providers and partners.

    Under the conditions defined by the French Data Protection Act and the European Data Protection Regulation, individuals have the right to access, rectify, question, limit, portability and delete data concerning them.

    The data subjects of the processing operations also have the right to object at any time, for reasons relating to their particular situation, to the processing of personal data whose legal basis is the legitimate interest of the Organiser, as well as the right to object to commercial prospecting.

    They also have the right to define general and specific directives defining the way in which they intend the above-mentioned rights to be exercised after their death, by e-mail to the following address: eric.razzoli@ericaucarre.com or by post to the following address: ERIC AU CARRE - 44 rue Montgrand - 13006 MARSEILLE, accompanied by a copy of a signed identity document.

    The persons concerned have the right to lodge a complaint with the CNIL.

    ARTICLE 12 - GENERAL CONDITIONS

    All competitors agree to abide by the rules of the event by the mere fact of their registration and release the organisers from liability for any incident or accident that may occur before, during or after the event. The organisation reserves the right to modify the present rules after validation by the administrative authorities, in particular according to the health crisis.

    ARTICLE 13 - CANCELLATION

    1/ On the runner's part: no reimbursement will be made after registration, except in cases of force majeure (death, serious illness, etc.). Participants may take out cancellation insurance at the time of registration. In the event of cancellation, he/she may request reimbursement directly from the insurer, via the registration platform, up to 24 hours before the start of race number collection, i.e. April 18, 2024.

    The reimbursement amounts to 80% of the registration fee (excluding any options, application fees / bank charges) and will be paid directly by the insurance company.

    Reimbursement will be granted without providing any supporting documentation, only in the case of a reason provided by the insurer.

    2 / Due to the organisation: The Organiser, without being held responsible, reserves the right to modify the organisation of the event, in particular to modify the routes after validation by the administrative authorities, without the participants being able to claim any reimbursement or compensation whatsoever, in particular in the event of force majeure, natural disaster, prefectural decree or for any reason beyond its control.

    For the purposes hereof, the Parties agree to attribute the effects of force majeure to the following events: fire, weather conditions making it impossible or very difficult to hold the event, and in particular : flood, epidemic (including coronavirus epidemic) accompanied by restrictive sanitary measures, pandemic, attack (or threat of attack), hurricane, tornado, storm, frost, earthquake, war, civil war, requisition, work stoppage, lock-out or strike of personnel necessary for the organization of the event, revolution, riots, crowd movement, legal moratorium, fait du prince, non-obtainment, withdrawal or suspension of federal, local administrative or other authorizations, non-obtainment, withdrawal or suspension of travel authorizations, theft of all or part of the equipment required to hold sporting events, lack of electrical power making it impossible or very difficult to record data on the site, substantial defection of participants to the Event.

    In the event of "force majeure" forcing the Organiser to cancel the event, only a part of the registration fees actually collected may be refunded as follows:

    • Cancellation before 01/31/2024: 100% refund
    • Between 02/01/2024 and 02/28/2024: repayment at 85%.
    • From 01/03/2024: repayment at 75%.

    The registration fees for LiveTrail are not included in the calculation basis and are retained by LiveTrail.

    ARTICLE 14 - RIGHT OF SEIZURE

    The organising company reserves the right to inform the competent authorities of any deliberate nuisance to the smooth running of the event (clearing, obstruction of the course, noise, visual disturbance, etc.).

    ARTICLE 15 - FAILURE TO COMPLY WITH THE RULES

    (*) Time penalties are applicable immediately on the spot, i.e. the runner must interrupt his race for the duration of the penalty. Any other breach of the rules will be subject to a penalty decided by the Race Direction.

    ARTICLE 16 - APPLICABLE LAW AND JURISDICTION

    In the event of difficulty, the rider shall have the possibility, before any legal action is taken, of seeking an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other adviser of his choice.

    In the event of a dispute, the rider must first send his complaint by post to the company's head office address: 44 rue Montgrand - 13006 MARSEILLE.

    If no solution is found within 21 days of the request, the rider is informed that he/she may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (L. 612-1 of the French Consumer Code) or with existing sectoral mediation bodies, or to any alternative dispute resolution method.

    In the absence of an amicable agreement, the rider may refer any dispute relating to the race to the competent court.

      ARTICLE 17 - ACCEPTANCE OF THE RULES

      The participation to the FULL MOON TRAIL implies the express and unconditional acceptance by each participant of the present rules.

      Each participant acknowledges having read these rules and accepts them in full.
